Apply for a permit to use part of a street or sidewalk

You need an encroachment permit to use the public right-of-way, like streets, sidewalks, or alleys.

Need to know

  • Costs vary based on type of permit
  • Submit your application at least 5 business days before the planned activity
  • Work hours are limited to (unless otherwise approved):
    • Monday thru Friday
    • 7 a.m. to 5 p.m.
  • Traffic control plans required for lane or sidewalk closures
  • Insurance and contractor license are required for most construction-related permits

Types of permits

There are different types of encroachment permits based on your project needs. Before you start your application, figure out the type you need.

Requirements

You need to upload these documents when you apply online.

Proof of insurance

  • General Liability for at least $1 million
  • Automobile Liability for at least $1 million
  • Name the City of San Rafael as an additional insured along with the endorsement page

Detailed plan and key map

Show the exact location, a more precise extent of the work zone, the work proposed and details of the improvements. A key map shows the general project location and approximate extent of the work zone. Underground utilities can be shown on the detailed plan or as a separate map. We use this to generally locate where subsurface utilities exist, and to avoid conflicts with existing facilities.

Traffic control plan (if required)

Shows temporary signs, cones, and flaggers to safely direct traffic around your work zone. Includes vehicles, bicycles, pedestrians, and mobility devices such as wheelchairs.

Required licenses

  • City of San Rafael business license: If you don’t have a business license, you can apply online.
  • Contractor license: An A or C-12 license is required for all paving. Other licenses may be required based on project scope.

Signed agreements

Download and sign the indemnification, general provisions, and standard conditions agreements.

Steps

1. Start the online application

Login to our online permit system. If you haven't used it before, you'll need to set up an account.

2. Fill out your application and pay fee

Upload the required documents.

You can pay by:

  • Credit card
  • Check payable to City of San Rafael

What's next

We will review your application. If more information is needed, we will contact you. Approval usually takes about 5 business days.

Once approved, you’ll get a permit with conditions and any special instructions. Keep a copy at the work site.

Notification

Before and during your project, you need to provide notice about it. This includes us and the public.

Construction and restoration standards

If you do work within the public right-of-way, you need to meet our construction and restoration standards.

Barricades

If you use barricades, make sure they follow the City's construction barricade rules.

Inspections

Schedule a progress inspection before the following:

  • Pouring of concrete
  • Backfill of trench
  • Pavement restoration
  • Any work in the public right of way associated with the project
  • Final inspection (before permit expiration date)

For all storage containers and debris boxes, send a photo of the structure’s drop off location.

To request inspections, email us with the requested date and time.

Inspections are scheduled based on staff availability. If your requested date and time is not available, we reserve the right to reschedule. We also reserves the right to request compaction tests for all trench work and will notify the contractor if this will be needed to final the permit.

If you do not notify us before backfilling of trenches and/or restoration of the right-of-way you may need to re-excavate the project.
